1. Purpose and Scope
This Privacy Policy (hereinafter, the “Policy”) governs the collection, processing, storage, and protection of personal data of individuals and legal entities (hereinafter, the “User” or “Users”) who access or utilize the services, platforms, portals, servers, and website (collectively, the “Services”) provided by BCL Payments SRL (hereinafter, the “Company”).
Use of the Services constitutes acceptance of this Policy. Any User who does not agree with the provisions herein must refrain from using the Services.
2. Legal Basis and Binding Effect
The Company collects and processes personal data in compliance with Law No. 25.326 on the Protection of Personal Data and related regulations. This Policy forms a binding agreement between the Company and the User regarding the handling of personal data, without prejudice to any other contractual arrangements executed between the User and the Company. In the event of conflict, the specific contractual provisions shall prevail.

The Company may collect the following personal data from Users:
- Identification information (e.g., name, date of birth, identification documents)

- Account credentials (e.g., username, password, authentication keys)
- Transactional information related to use of the Services
The collected data shall be processed exclusively for legitimate, specific, and explicit purposes, including:

- Verification of User identity and beneficial ownership
- Prevention of fraud, money laundering, and financing of terrorism
- Compliance with legal, regulatory, and tax obligations

Users are responsible for maintaining the confidentiality of their access credentials and shall not share them with third parties. The Company shall not be liable for any operations performed through the User’s account using authorized credentials.

The Company shall not disclose personal data to third parties without the User’s prior, informed, and express consent, except in cases authorized by law or to comply with regulatory requirements, including obligations under Law No. 25.246 and directives issued by the Unidad de Información Financiera (UIF).

Users have the right to:

- Rectify or update inaccurate or incomplete data
- Request deletion of personal data, subject to legal and contractual obligations
- Exercise any other rights recognized under Law No. 25.326

8. Liability and Limitation
The Company undertakes reasonable efforts to protect personal data; however, it shall not be liable for indirect, incidental, or consequential damages arising from unauthorized access or misuse of data by third parties beyond the Company’s control.
9. Intellectual Property
All content, materials, and intellectual property associated with the Services remain the exclusive property of BCL Payments SRL unless otherwise expressly indicated. Unauthorized reproduction, distribution, or modification is prohibited under applicable law.
10. Governing Law and Jurisdiction
This Policy shall be governed by the laws of the Argentine Republic. Any disputes arising from the interpretation, application, or enforcement of this Policy shall be submitted to the jurisdiction of the Ordinary Courts of the City of La Plata, Province of Buenos Aires, expressly waiving any other jurisdiction.
